Application for registration of amendments
An administrator which proposes to apply for the registration of an amendment must
inform the plan members and file an
application for registration with Retraite Québec.
Prescribed time limit for registering an amendment
Applications for the registration of amendments must be filed within a reasonable period of time.
However, for employers who join a pension plan, the application for registration must be filed with Retraite Québec within 12 months of the date as of which the employer became party to the plan, unless an extension has been granted by Retraite Québec.
Documents included with application for registration of amendments
a copy of the amendment certified to be a true copy by the plan administrator, and where the plan is insured, a copy of the insurance contract certified to be a true copy by the insurer
A copy is certified to be true where a person authorized to do so must sign a declaration indicating that the amendment is a certified true copy of the original. It can be a photocopy of the original, but it must bear the original signature following the declaration. An
electronic signature is accepted provided that it is produced with one of the electronic processes allowed by Retraite Québec for a form. Typed signatures are not accepted.
the written consent from all employers party to the plan who have obligations as a result of the amendment
a copy of the
notice informing members
the plan's actuarial valuation, if applicable
The valuation must be sent within the time prescribed under
section 119 of the Supplemental Pension Plans Act
the other documents or information set out in
section 2 of the Regulation respecting supplemental pension plans
the
fees prescribed by regulation, if applicable.
